基礎階段，為學生夯實基礎，主要是積累單詞量以及句子分析能力的階段。但是，在這一階段的復習過程中，在詞匯和句法復習方面時常會碰到一些共同的問題。我們萬學海文考研(論壇) 英語教研室的老師在對學生的輔導過程中，發現學生在基礎階段的復習中，在單詞記憶以及句子分析兩個方面，主要的問題表現為以下兩點。

這是摘自《經濟學人》中的一篇文章中的一句話。學生不理解Instead的用法，不理解back在這里是什么意思，也不理解“graduated response”指的是什么。
instead只是一個副詞，表示“相反”，與上文形成對比，理解它的意思就可以了。但是，在考研里，它算是一個比較常見的邏輯關聯詞，就像but一類轉折詞一樣，拼接句子之間的邏輯關系?？佳虚喿x中，熟詞生義是一個非常常見的現象。
back，是一個簡單詞，而在考研中，不考它的常見意思，而是考它的辟義。back可以做動詞，表示"支持"，此句就是用了它這個意思。考研閱讀在詞的考查這一方面，還會考查詞的搭配。

這個句子難點在于he指代，以及the damages所指。
he指代the judge，這段第二句提到，該法官表示自己在判決中出了錯誤。第三句就緊接著說這位法官做出進一步表示。
calling理解為“堅稱，認為..”，call sth +adj表示“認為某事怎么樣”。damages是指給雙方造成的損失，唱片被盜給Wal-Mart 帶來的損失，以及判決對Ms.Thomas-Rasset帶來的危害。之后的disproportionate，“不成比例地”，也可以暗示一定是指兩方面的比例協調關系。call the damages the wholly disproportionate，意思就清楚了，即“認為給雙方造成的危害不對等，不成比例”，暗示給Ms.Thomas-Rasset的判決太重，就因為盜版CD，就判這么嚴重，比例失衡，不足以判那么嚴重的罪。
句子末尾部分，Ms.Thomas-Rasset was an individual who ...，可以采取融合法，Ms.Thomas-Rasset是一個什么樣的人，或直接說Ms.Thomas-Rasset怎么樣了。所以，這部分老師給你的參考譯文是：Ms.Thomas-Rasset 并沒有試圖從盜竊中獲利。
